By using the neighborhoodpostcards.com web site (“Service”), services of Neighborhood Postcards LLC (“Neighborhood Postcards LLC”), you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Neighborhood Postcards LLC reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at: http://neighborhoodpostcards.com/terms Violation of any of the terms below will result in the termination of your Account.
You must be 13 years or older to use the mobile application. You must be a human. Accounts registered by “bots” or other automated methods are not permitted. You are responsible for maintaining the security of your account and password. Neighborhood Postcards LLC cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
Neighborhood Postcards LLC will arrange for printing, preparation, and mailing of accepted orders in accordance with the options selected at checkout. Once mail is handed to the United States Postal Service (“USPS”), USPS is responsible for its handling and delivery. Neighborhood Postcards LLC does not control USPS operations or delivery timing.
Any delivery date or delivery timeframe shown or communicated by us is an estimate, not a guarantee. Actual delivery may vary based on USPS operations, weather, address quality, or other circumstances outside our reasonable control.
If you believe an order was not mailed or delivered, you must contact us at support@neighborhoodpostcards.com within 14 calendar days of the mailing date and include your order number and a description of the issue. We may request additional information to investigate the claim.
For a confirmed non-delivery claim, and to the extent permitted by law, your sole and exclusive remedy is, at our election, either a reprint and remailing of the affected order or a refund of the amount you paid for that affected order. Our total liability for a claim relating to an affected order will not exceed the amount you paid for that order. These limits do not apply to liability that cannot legally be limited or to rights that cannot legally be waived.
A valid credit card is required for placing orders. Neighborhood Postcards LLC, in its sole discretion, has the right to suspend or terminate your access and refuse any and all current or future use of the Service, or any other Neighborhood Postcards LLC service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. Neighborhood Postcards LLC reserves the right to refuse service to anyone for any reason at any time.
Neighborhood Postcards LLC reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
Prices of all Services, including monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the neighborhoodpostcards Site (neighborhoodpostcards.com) or the Service itself. Neighborhood Postcards LLC shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
We claim no property rights over the material you provide to the Service. Your uploaded data remains yours. Neighborhood Postcards LLC will not share the content of your account with any third parties, unless you provide an explicit permission to do so. Your logins will only be used to access your data.
The look and feel of the Service is copyright © neighborhoodpostcards, LLC. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML/CSS or visual design elements without express written permission from Neighborhood Postcards LLC.
Informal Resolution First. Before starting arbitration or a court proceeding, you and Neighborhood Postcards LLC agree to try to resolve the dispute in good faith. You must first contact us at support@neighborhoodpostcards.com and provide your name, account email address, order number if applicable, a description of the dispute, and the resolution you are seeking. If the dispute is not resolved within 30 days after we receive your notice, either party may proceed as permitted by this section. This informal-resolution process does not prevent either party from seeking temporary or emergency relief where necessary.
Agreement to Arbitrate. Except for claims that may be brought in small claims court as described below, you and Neighborhood Postcards LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms of Service, the Service, an order, or the relationship between you and Neighborhood Postcards LLC will be resolved by final and binding individual arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules in effect when the arbitration is filed, as modified by this section. The AAA is the arbitration provider selected by Neighborhood Postcards LLC for these disputes. The arbitrator will be selected and appointed under the applicable AAA rules; neither party may unilaterally appoint the arbitrator. The arbitrator may award the same individual relief that a court could award under applicable law, subject to the limitations in these Terms of Service and applicable law. Judgment on the arbitration award may be entered in any court with jurisdiction.
Arbitration Fees and Location. AAA consumer fee limitations and procedures will apply. Neighborhood Postcards LLC will pay arbitration fees that exceed the amount you would have been required to pay to bring the same claim in court, except where applicable law or the AAA rules require a different allocation. Unless the parties agree otherwise or the AAA rules require otherwise, the arbitration may be conducted remotely or in a location reasonably convenient to you.
Individual Proceedings; Class Action Waiver. You and Neighborhood Postcards LLC may bring claims against each other only in an individual capacity. Neither party may bring or participate in a class, collective, consolidated, or representative action or arbitration, or seek relief on behalf of other persons. The arbitrator may not combine claims of different persons or preside over any class, collective, consolidated, or representative proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
Small Claims Court. Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court. If a claim is filed in arbitration but is within the jurisdiction of a small claims court, either party may elect to have that individual claim heard in small claims court, and the arbitration will be stayed or dismissed as to that claim as appropriate. Small claims proceedings must remain individual and may not proceed as a class, collective, or representative action.
30-Day Arbitration Opt-Out. You may opt out of this agreement to arbitrate by emailing support@neighborhoodpostcards.com within 30 days after your first purchase from Neighborhood Postcards LLC. Your email must include your name, the email address associated with your account, and a clear statement that you wish to opt out of the arbitration agreement. Opting out of arbitration will not affect the other provisions of these Terms of Service.
Governing Law. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. Except where federal law applies or the FAA preempts state law, the laws of the State of Delaware govern these Terms of Service and disputes arising from them, without regard to conflict-of-law principles.
Severability. If a court determines that a claim must be heard in small claims court, that claim will proceed individually in small claims court, and the remainder of this section will remain in effect to the extent permitted by law. If the prohibition on class, collective, consolidated, or representative proceedings is found unenforceable as to a particular claim, that claim will proceed individually in a court of competent jurisdiction, not as a class action, and any enforceable individual claims subject to arbitration will remain subject to arbitration. If any other part of this section is found unenforceable, the remaining parts will remain in effect to the extent permitted by law.
Your use of the Service is at your sole risk. The service is provided on an “as is” and “as available” basis.
Technical support is only provided to paying account holders and is available via email and phone. You understand that Neighborhood Postcards LLC uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
You must not modify, adapt or hack the Service or modify another website so as to falsely imply that it is associated with the Service, Neighborhood Postcards LLC, or any other Neighborhood Postcards LLC service.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Neighborhood Postcards LLC.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Neighborhood Postcards LLC customer, employee, member, or officer will result in immediate account termination.
You understand that the technical processing and transmission of the Service, including your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. You must not transmit any worms or viruses or any code of a destructive nature.
If your bandwidth usage exceeds 300 MB/month, or significantly exceeds the average bandwidth usage (as determined solely by Neighborhood Postcards LLC) of other neighborhoodpostcards customers, we reserve the right to immediately disable your account or throttle your file hosting until you can reduce your bandwidth consumption.
Neighborhood Postcards LLC does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the Service will be corrected.
You expressly understand and agree that Neighborhood Postcards LLC shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Neighborhood Postcards LLC has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to the service.
The failure of Neighborhood Postcards LLC to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Neighborhood Postcards LLC and govern your use of the Service, superceding any prior agreements between you and Neighborhood Postcards LLC (including, but not limited to, any prior versions of the Terms of Service), and incorporates our Privacy Policy at neighborhoodpostcards.com/privacy.html by reference. If any provision of these Terms of Service is found unenforceable, the remaining provisions will remain in effect, except as otherwise provided in the Dispute Resolution section above.
