This Privacy Policy applies to the neighborhoodpostcards.com website, the Neighborhood Postcards mobile applications, and related services (collectively, the "Service") operated by Neighborhood Postcards LLC ("Neighborhood Postcards," "we," "us," or "our"). For purposes of applicable privacy laws, Neighborhood Postcards LLC is the controller of the Personal Data described in this policy.
Questions or requests may be sent to support@neighborhoodpostcards.com.
We collect the following categories of Personal Data, provided by you or collected automatically when you use the Service:
Account and contact information. Name, email address, phone number, business name, and account credentials when you create an account or contact us.
Order and payment information. Order details, mailing selections, and billing information. Payments are processed by third-party payment processors, and we do not store full credit card numbers on our systems.
Mailing and design content. The addresses, mailing lists, images, and text you upload or select in order to produce and mail postcards and other products. Where you select a mailing audience through the Service rather than uploading your own list, the recipient addresses used for your order are obtained from third-party data providers, including data aggregators and list brokers, in response to your targeting selections. We do not use these addresses for any purpose other than fulfilling your order.
Location information. Geographic position or selected mailing areas when needed to provide the location-based features of the Service.
Usage and device data. Information collected automatically, such as IP address, browser and device characteristics, pages visited, time spent on pages, referring pages, and other usage data collected through cookies and similar technologies.
Communications. Information you provide when you contact support, respond to our communications, or participate in surveys or promotions.
Failure to provide certain Personal Data may make it impossible for us to provide the requested services. You are responsible for ensuring you have the right to provide Personal Data of third parties (such as mailing list recipients) to the Service.
We use Personal Data to:
Provide, operate, maintain, and improve the Service, including printing, addressing, stamping, and mailing your orders; obtain and validate recipient addresses from data providers for the mailing audiences you select; process payments and prevent fraudulent transactions; communicate with you about your orders, account, and support requests; send service updates and, where permitted, marketing communications you can opt out of at any time; measure and analyze usage of the Service; comply with legal obligations, resolve disputes, and enforce our agreements; and protect the security and integrity of the Service.
We do not sell Personal Data, and we do not share Personal Data for cross-context behavioral advertising as those terms are defined by applicable California law.
We share Personal Data only in the following circumstances:
Service providers. With vendors and partners who perform services on our behalf, including payment processing, hosting, printing, mail preparation, USPS and other mail carriers, address validation, data providers and list brokers that supply recipient addresses for mailing audiences you select, analytics, and customer support tools. These parties process data only as needed to provide their services to us.
Mailing fulfillment. When you place a mailing order, recipient address data is shared with printing and mailing partners and USPS as necessary to produce and deliver your mail. This processing is performed on your instructions as part of the Service.
Legal purposes. Where required by law, legal process, or governmental request, or to protect the rights, property, or safety of Neighborhood Postcards, our users, or others.
Business transfers. In connection with a merger, acquisition, financing, or sale of assets, Personal Data may be transferred subject to this policy.
We do not share account content with third parties except as described in this policy, in our Terms of Service, or with your explicit permission.
When you upload a mailing list, you represent that you have collected the recipient data lawfully and have any permissions required to use it for mailings. Where you select a mailing audience through the Service, recipient addresses are provided by third-party data providers under agreements with us.
Recipients who wish to stop receiving addressed mailed advertising sent through our Service may submit a request at neighborhoodpostcards.com/optout, and we will honor opt-out requests in accordance with applicable law. Where recipient data is supplied by a data provider, we may also forward the request to that provider, and recipients may additionally contact the data provider directly. Requests to no longer receive mail may take a reasonable period to take effect across all providers, and recipients may continue to receive mail from senders who use their own uploaded lists.
Please note that some mailings sent through the Service are unaddressed, route-based mailings delivered to all addresses along a selected postal route. Because these mailings are not directed to specific named recipients, opt-out requests cannot be applied to them. Recipients may also register with DMAchoice, the mail preference service of the Association of National Advertisers, at dmachoice.org to reduce addressed promotional mail from many marketers.
We and our service providers use cookies and similar technologies to operate the Service, remember preferences, keep users signed in, measure performance, and understand usage. Most browsers allow you to refuse or delete cookies through their settings; doing so may affect the functionality of the Service. Where we offer cookie preference tools, you may use them to manage optional cookies.
Some browsers offer "Do Not Track" signals. There is no consistent industry standard for responding to Do Not Track signals, and the Service does not respond to them at this time. Third-party services used through the Service may have their own tracking practices; please review their privacy policies.
We keep Personal Data for as long as your account is active or as needed to provide the Service and fulfill your orders. After that, we retain Personal Data only as long as required to comply with legal, accounting, and tax obligations, resolve disputes, and enforce our agreements. Order records, including mailing addresses used for an order, are retained as required for business and legal purposes. When data is no longer required, we delete or de-identify it. You may request deletion as described below, subject to our retention obligations.
We use commercially reasonable safeguards, including administrative, technical, and physical measures, to protect Personal Data against unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Depending on your state of residence, including California and other states with consumer privacy laws, you may have some or all of the following rights:
To know what Personal Data we hold about you and to request access to it; to request correction of inaccurate Personal Data; to request deletion of your Personal Data, subject to legal retention requirements; to opt out of the sale or sharing of Personal Data (we do not sell or share Personal Data as defined by applicable law); and not to be discriminated against for exercising your rights.
To exercise any of these rights, contact us at support@neighborhoodpostcards.com with your name, the email address associated with your account, and the request you wish to make. We will respond to verified requests within 45 days of receipt. Where reasonably necessary, we may extend the response period once by an additional 45 days, and we will notify you of any extension and the reason for it. We may need to verify your identity before processing the request.
Authorized agents. If you are an authorized agent submitting a request on behalf of a consumer, we may require written permission from the consumer, or proof of a valid power of attorney, before processing the request.
Marketing emails include an unsubscribe link. You may also opt out of marketing communications by contacting support.
If your request concerns mail you received through our Service, you may also submit it at neighborhoodpostcards.com/optout. Where the recipient data concerned was obtained from a third-party data provider, your request may be handled with, or forwarded to, that provider.
The Service is not directed to children under 13, and we do not knowingly collect Personal Data from children under 13. If you believe a child has provided us Personal Data, contact us and we will delete it.
Personal Data may be used for legal purposes by Neighborhood Postcards LLC, in court or in the stages leading to possible legal action arising from improper use of the Service or related services. We may be required to reveal Personal Data upon request of public authorities.
We may update this Privacy Policy from time to time. The current version is always available at neighborhoodpostcards.com/privacy.html. If we make material changes, we will post the updated policy on this page and update the date below, and where required by law we will provide additional notice or obtain your consent.
